These Terms of Service (“Terms”) form a legally binding agreement between you and NOWFit, Inc. (“NOWFit,” “we,” “us,” or “our”). By downloading, installing, accessing, or using the NOWFit mobile application (the “App”) or any related services, features, or content provided through it (collectively, the “Service”), you agree to be bound by these Terms, our Privacy Policy, and any supplemental policies or legal notices that may be presented within the Service.
If you do not agree with these Terms, you must not access or use the Service. Your use of the Service constitutes ongoing acceptance of these Terms, including any changes made.
You must be at least 18 years old to use the Service. If you are under 18, you may only use the Service with the consent of a parent or legal guardian, and your coach must verify this consent as part of onboarding. Coaches shall obtain and retain signed parental consent forms or other verifiable documentation as required by applicable laws, such as the Children’s Online Privacy Protection Act (COPPA) in the United States. You agree to provide complete and accurate registration information and to keep it updated.
You are solely responsible for maintaining the confidentiality of your login credentials. You may not share your account or credentials with anyone else. If you become aware of unauthorized use, you must notify us immediately.
NOWFit provides a digital platform that connects clients with fitness professionals (“coaches”) who use the NOWFit coaching platform. Through the App, clients may:
NOWFit itself does not provide health, wellness, medical, nutritional, or training advice and acts solely as a service provider for the delivery of such services through coaches. NOWFit is not a covered entity under HIPAA and does not provide healthcare services. Users should consult professionals for medical advice.
Your use of the Service involves interaction with a coach who may be an independent business owner. You understand and agree that:
You acknowledge that any payment you make through the platform is routed to your coach via a Stripe payment processing integration. NOWFit facilitates this infrastructure but does not serve as a legal agent or medical advisor.
Payment for coaching services is transacted via Stripe. By using the Service, you authorize Stripe and any other payment processing providers used by your coach to charge your designated payment method.
Payments are non-refundable unless otherwise arranged directly with your coach. NOWFit does not issue or mediate refunds and disclaims all liability related to financial transactions between you and your coach. In case of disputes, users agree to first contact their coach before initiating chargebacks.
The App includes optional AI-powered tools designed to improve the client experience. These tools may provide:
You may choose to disable direct AI communication at any time through the app settings. However, anonymized data may still be used to generate insights or recommendations visible to your coach.
AI features are beta/experimental and may contain errors. Anonymization follows industry standards (e.g., removing identifiers). You may opt out of all AI data uses, including backend processing, through your app settings. AI responses are strictly informational and are not substitutes for professional or medical advice. You should always defer to your coach or healthcare provider for personalized guidance.
Physical activity carries inherent risks. By using the Service, you affirm that:
NOWFit is not responsible for any injuries, health deterioration, allergic reactions, or unintended consequences resulting from use of the App or services received via the App. Users with medical conditions should provide details to their coach for tailored programs. During onboarding, you must confirm via an in-app checkbox that you have consulted a physician.
You may upload or submit photos, logs, reflections, form submissions, and other materials (“User Content”). You retain ownership of your User Content, but by uploading it, you:
We do not claim ownership of your User Content and will not use it for any public marketing without your consent. In the event of a data breach involving User Content, NOWFit will notify affected users within 72 hours, as required by applicable law.

By providing your email or phone number, you agree to receive transactional communications and optional messages from your coach. NOWFit may send product updates or marketing communications, which you may opt out of at any time.

Violation of these terms may result in account suspension or termination.
You may terminate your account at any time through your coach or by submitting a request to support@nowfitonline.com. Upon termination:
NOWFit reserves the right to terminate any account for violation of these Terms or illegal activity. Users may appeal suspensions or terminations via support@nowfitonline.com within 30 days. Data backups will be limited to as required by law or for 30 days post-termination.
All platform code, features, designs, and content (excluding User Content and Coach Content) are the intellectual property of NOWFit, Inc. You may not reproduce, distribute, modify, reverse-engineer, or commercially exploit any part of the Service without written consent.
To the fullest extent permitted by law, NOWFit disclaims all liability related to:
In no event shall NOWFit’s liability exceed $100 USD or the total amount paid by you for use of the Service within the previous six months.
These Terms are governed by the laws of the State of Nevada. Any disputes shall be resolved by binding arbitration in Clark County, Nevada. Class action waivers apply. Each party is responsible for its own legal costs unless otherwise determined.
NOWFit reserves the right to modify or update these Terms at any time. Material changes will be posted in-app or via email. Continued use of the Service constitutes acceptance of updated Terms. For material changes affecting privacy rights, we will seek affirmative consent where required by law.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
